SpotAware Terms of Use

1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of SpotAware's iOS and Android applications and website. By accessing or using SpotAware, you agree to these Terms. If you do not agree, do not use the service.

2. Eligibility — 13+

You must be at least 13 years old to use SpotAware. If you are under the age at which you can agree to online terms in your jurisdiction, a parent or guardian must authorize your use where required by applicable law.

3. Description of Service

SpotAware is a community-powered local-updates app designed to help users avoid wasted trips by checking recent local reports before leaving. The product model is Check. Decide. Share. SpotAware is available through iOS and Android applications and the SpotAware website.

4. Community-Powered Information

SpotAware depends on recent reports submitted by community members. Coverage may vary by place and time. Pins are community reports, not official statements. You should independently assess information before relying on it.

5. Account Responsibilities

You are responsible for information submitted through your account and for using the service lawfully. Keep your sign-in credentials confidential, do not share access improperly, and notify SpotAware at info@spotaware.app if you have an account-security concern.

6. Acceptable Use

You may not use SpotAware to:

• Break the law or facilitate illegal activity.
• Interfere with, disrupt, damage, probe, or misuse the service or another user's access.
• Attempt unauthorized access to accounts, systems, or information.
• Harass, threaten, deceive, impersonate, or exploit another person.
• Misuse SpotAware as an emergency-reporting channel.

7. Pin and User-Content Rules

Submit only conditions you personally observed. Pins and other user content must not contain:

• False, staged, exaggerated, rumored, or outdated reports.
• Private or sensitive personal information.
• Harassment, threats, or illegal content.
• Emergency misuse or impersonation.
• Content that violates intellectual-property rights.

You remain responsible for content you submit. SpotAware may remove content or accounts that violate these rules.

8. Location Requirement

To create a pin, you must be within 500 meters of the reported place. When location permission is granted, SpotAware may use precise device location during the active session to confirm this requirement and support other location functions described in the Privacy Policy.

9. Pin Duration

Pins remain active for 12 hours. This describes how long a pin remains visible as a current community update; it does not necessarily indicate when related operational records are deleted. A pin's active period does not guarantee that the reported condition remains unchanged throughout that period.

10. Guest, Free, and Pro Access

SpotAware may provide a limited number of free pin views. After the available free views are used, a Pro subscription may be required to view additional pins. Users may still be permitted to contribute qualifying community reports, subject to the current product rules.

Features and access levels may differ among guest, free, and Pro use. Location subscriptions, saved-place alerts, geofencing, and location-triggered alerts are not currently available.

11. Subscriptions and Billing

Monthly and yearly Pro plans may be offered. Exact pricing appears in the applicable app store before purchase. Purchases and renewals are handled through Apple or Google. Cancellation and refund requests are governed by the applicable app-store terms.

12. No Emergency or Official Information

SpotAware is not emergency infrastructure, a crime-alert service, a weather-alert service, a government-alert system, navigation or route-planning software, an official business-hours service, an inventory service, a reservation service, or a parking-payment service.

Do not use SpotAware to request or provide emergency assistance. Contact the appropriate emergency services when immediate help is required.

13. Accuracy and Availability Disclaimer

SpotAware does not guarantee complete, continuously available, official, or real-time coverage. Reports may be incomplete, inaccurate, outdated, unavailable, or changed after posting. Service availability may vary. You are responsible for deciding whether and how to act on community information.

14. Intellectual Property

SpotAware and its licensors retain their respective rights in the service, software, branding, and materials they own. These Terms do not transfer ownership to you. You may use SpotAware only as permitted by these Terms and applicable law.

You retain the rights you hold in content you submit. By submitting content, you authorize SpotAware to host, process, display, and use it as necessary to operate, secure, moderate, and provide the service, subject to the Privacy Policy and applicable law.

15. Feedback

If you provide ideas, suggestions, or other feedback, you authorize SpotAware to consider and use that feedback to improve the service without an obligation to adopt it. Personal information included in feedback is handled under the Privacy Policy.

16. Account Suspension and Termination

SpotAware may suspend or terminate access, or remove content, when reasonably necessary to address violations of these Terms, illegal activity, security concerns, abuse, or risks to the service or its users.

17. Account Deletion

Account deletion is available inside both the iOS and Android apps. When you delete your SpotAware account, SpotAware permanently deletes your account and all associated data controlled by SpotAware. SpotAware also directs its service providers to delete associated data they process on SpotAware's behalf, where applicable. SpotAware does not retain that account data after deletion.

Records independently controlled by Apple, Google, app stores, subscription providers, payment providers, or other third parties may remain subject to those providers' own policies and legal obligations. See Delete Your SpotAware Account.

18. Third-Party Services

SpotAware uses or connects with third-party services that may include Amazon Web Services, Google Maps, Google Places, Google geocoding, Firebase, RevenueCat, Apple, Google, Google Analytics, and Microsoft Clarity. Those providers operate under their own terms and privacy policies. SpotAware does not control independently maintained third-party records or services.

19. Disclaimers

To the fullest extent permitted by applicable law, SpotAware is provided on an "as is" and "as available" basis. SpotAware disclaims warranties that the service or community reports will be uninterrupted, error-free, complete, accurate, official, current, or suitable for a particular decision. Nothing in these Terms excludes a warranty that cannot lawfully be excluded.

20. Limitation of Liability

To the fullest extent permitted by applicable law, SpotAware LLC and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the service, community reports, coverage gaps, reliance on a pin, or third-party services. SpotAware does not exclude or limit liability where doing so is prohibited by law.

21. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless SpotAware LLC from claims, losses, liabilities, and reasonable costs arising from your unlawful use of the service, your content, or your material violation of these Terms. This obligation does not apply where prohibited by law.

22. Changes to the Service or Terms

SpotAware may change the service or these Terms as the product or applicable requirements change. Updated Terms will show a new effective date. SpotAware will provide notice when required by applicable law.

23. Governing Law — California

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles, except where applicable law requires otherwise.

24. Severability

If a provision of these Terms is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue in effect.
